How the complaint says it happened

What follows is drawn entirely from the plaintiffs’ complaint in Shaw v. Mwale. These are allegations — the Mwales’ side is not pleaded here, and no court has ruled on the merits. Read the source document yourself.

Chapter 01 — February 2022

First contact at a private dinner

Mathew and Brooke Shaw first met Julius and Kaila Mwale on February 18, 2022, at the Holladay, Utah home of Gordon Bowen — a private dinner party where Mat and the Shaws’ oldest daughter Savanna performed for wealthy guests. The complaint states the Mwales, presenting themselves as billionaires, bonded with the Shaws “initially under the guise that their children could be friends,” and soon expressed interest in being “godparents” to the Shaw children.

Chapter 02 — Spring 2022

The credibility operation

According to the complaint, Julius then began texting Mat recordings of supposedly private video calls and emails with prominent figures — Senator Mitt Romney, Ambassador Meg Whitman, Google CFO Ruth Porat, UN World Food Programme chief David Beasley — plus supposedly confidential contracts with prominent companies, all “in an apparent effort to bolster his credibility.”

ClaimedOwned a private jet; children filmed aboard “their” jet.
Complaint allegesThe jet was leased from a company in which Julius has no ownership interest.
ClaimedOwned the San Jose estate; showed off cars “worth hundreds of thousands,” a $250M wine cellar, $870M in jewelry.
Complaint allegesNeither Julius nor any holding company he owns has title to the estate.

The complaint’s thesis: every display was designed “to suggest to the Shaws that the Mwales were persons of importance and influence… and that associating with them would provide the Shaws with potentially lucrative opportunities.”

Chapter 03 — March–May 2022

The pitch

By March 2022 the Mwales were, the complaint states, “pushing the Shaws to contribute to a series of investment opportunities run by Julius” — framed as “changing the world,” “solving world hunger,” and building “generational wealth.” At a March 18, 2022 meeting at the San Jose estate, the Shaws were told their money would go toward a battery manufacturing plant and surrounding infrastructure. On May 20, 2022, Julius allegedly added: millions of acres gifted by African countries, 12 undeveloped cobalt mines including in the DRC, and a parent company, Tumaz and Tumaz, worth approximately $60 billion.

The alleged terms: money taken as a “loan” with a guaranteed 20% annual return, upside “ten times the initial contribution,” and a promise the Mwales would return the money on request — “even if it meant having to sell a few bottles from their wine collection.” The Shaws were told the “window was closing” and that a close circle was being “allowed” to contribute upwards of $50 million.

The cast introduced along the way, per the complaint: “Derek William,” a rocket scientist “poached” from Boeing who supposedly owned KE International, the “independent” engineering firm awarded the construction contracts; and “Christine Allyn,” Julius’s chief of staff and a former personal assistant to Kofi Annan.

Chapter 04 — April–June 2022

The money moves

“Swayed by these promises and assurances,” the Shaws made their first monetary contributions on April 4, 2022. By June 22, 2022, the complaint states, they had paid the Mwales a total of approximately $1.7 million.

Chapter 05 — August 2022

The Kenya trip

In August 2022 the Shaws flew to Kenya to see what their investment had built. What they found, the complaint alleges, bore no resemblance to the pitch:

The hospitalA “complete construction mess” — as it had been for 5+ years. One working wing; a run-down malaria clinic on the first floor; no cancer treatment facility; “simply a shell.”
The golf courseUnfinished. No clubhouse, no facilities — the greens had no holes.
The “rental homes”Vacant 10×10 concrete boxes, no facilities, no occupants.
The people“Derek William” is actually Derek William Knox — Kaila’s brother. “Christine Allyn” is Allyn Knox — Kaila’s sister, formerly Kofi Annan’s granddaughter’s nanny. Both lived with the Mwales.

Chapter 06 — September 2022 to June 2024

The refund that never came

On September 9, 2022, the Shaws asked for their money back. The complaint describes a lengthening chain of delays: a 60-to-90-day “due diligence” period, extended to 120 “business” days, with a “worst case” return date of March 5, 2023 — which came and went.

Through counsel, Kaila then signed a Loan Modification Agreement — including signed confessions of judgment — to repay in four installments over seven months. The final $850,000 installment, due November 15, 2023, was extended to January 24, 2024 (plus $20,000 interest → $870,000), then to March 2024, then to June 2024. The complaint states the $870,000 was never paid.

Chapter 07 — July 2024

The lawsuit

On July 19, 2024, Mathew and Brooke Shaw — represented by Dentons Durham Jones Pinegar of Salt Lake City — filed suit in the U.S. District Court for the District of Utah. Four causes of action:

COUNT 1

Fraud (both defendants) — 23 alleged misrepresentations and 10 alleged material omissions, from the billionaire act to the hospital, the jet, the mines, and the refund promises.

COUNT 2

Negligent misrepresentation (both defendants) — the same representations made, the complaint alleges, with no reasonable grounds for believing them true.

COUNT 3

Breach of contract (Kaila Mwale) — failure to pay the $870,000 final installment under the Loan Modification Agreement.

COUNT 4

Unjust enrichment (Julius Mwale; alternatively Kaila) — retention of the ~$1.7 million benefit conferred by the Shaws.

Damages sought include, “at a minimum,” the $870,000 the complaint says the Mwales still owe.

Chapter 08 — Summer/Fall 2024

The service saga

Between July 27 and August 8, 2024, a process server made five unsuccessful attempts at personal service at the Alamo, California residence described as the Mwales’ primary home — a gated property reachable only via intercom. Then, per the October 7, 2024 order: on August 12, 2024, defense counsel allegedly offered to make someone available to accept service if the plaintiffs took down a website publishing the complaint. The plaintiffs declined. On October 7, 2024, Magistrate Judge Daphne A. Oberg granted alternative service.
